For the generalizations of thermodynamics to obtain, it appears that a very ‘special’ initial condition of the universe is required. Is this initial condition itself in need of explanation? I argue that it is not. In so doing, I offer a framework in which to think about ‘special’ initial conditions in all areas of science, though I concentrate on the case of thermodynamics. I urge the view that it is not always a serious mark against a theory that it must (...) posit an ‘improbable’ initial condition. (shrink)

Experimental philosophy of language uses experimental methods developed in the cognitive sciences to investigate topics of interest to philosophers of language. This article describes the methodological background for the development of experimental approaches to topics in philosophy of language, distinguishes negative and positive projects in experimental philosophy of language, and evaluates experimental work on the reference of proper names and natural kind terms. The reliability of expert judgments vs. the judgments of ordinary speakers, the role that ambiguity plays in influencing (...) responses to experiments, and the reliability of metalinguistic judgments are also assessed. Philosophy of time, as practiced throughout the last hundred years, is both language- and existence-obsessed. It is language-obsessed in the sense that the primary venue for attacking questions about the nature of time—in sharp contrast to the primary venue for questions about space—has been philosophy of language. Although other areas of philosophy have long recognized that there is a yawning gap between language and the world, the message is spreading slowly in philosophy of time.[1] Since twentieth-century analytic philosophy as a (...) whole often drew metaphysical conclusions from arguments with linguistic premises, philosophy of time perhaps may be forgiven for this transgression. Connected to this language-saturated way of doing philosophy, however, is a hitherto unnoticed obsession, equally unhealthy; namely, an obsession with existence. Existence draws the very lines of debate in philosophy of time: “eternalists” believe past, present and future events all ‘equally’ exist, “possibilists” believe that past and present events exist, and “presentists” believe that only present events enjoy this lofty status.[2] These differences between what events exist as of some other time are supposed to explain the main puzzles surrounding time. This fixation on existence, I submit, is a lingering symptom of the language-saturated days of philosophy of time.[3] And just as linguistic issues such as the ineliminability of tense fail to elucidate time and temporal experience, so too do the “existence debates” fail to explain much of what is interesting about time. Philosophers should have more to say about such a fascinating topic. (shrink)

What critical characteristics do firms have that determine the scale and scope of corporate social responsibility activities they undertake? This paper examines two disparate predictors of corporate social performance. First, using the lens of the resource-based view, we examine the role of alliance network centrality on corporate social performance. We find that centrality enhances corporate social performance. Second, we investigate how board composition affects corporate social performance. Specifically, drawing on stakeholder theory, we find that the percentage of female directors predicts (...) greater corporate social performance. In addition, we look at the influence of outside directors on this relationship. Our findings show that the presence of more outside directors positively moderates the relationship between female directors and corporate social performance. (shrink)

This article argues that late Heidegger’s analyses of the Fourfold can be used as a methodological starting point for discourse analyses. It argues that the Fourfold points out elements or foundations of discursive structures that orient us to differing, and to some extent opposing, directions that are at the same time mutually interdependent. A discursive analysis of how the Fourfold is at play in prevailing discursive exchanges and structures will thus be a matter of situating ourselves in a conceptual space (...) beyond existing practices and structures, from which we get a picture of their inadequacies. As such, the article contributes to a critical understanding of discourse analysis. It will be argued that through understanding the Fourfold, we can better understand the problems with various aspects of ‘measuring’, which are founded upon the (concealed) instability of elements of the Fourfold – which shapes practical discursive engagements. By foregrounding this structural instability we can approach it critically. I demonstrate how this approach might be used in an analysis of a debate between Greta Thunberg and Bjørn Lomborg. While the plea of duress is generally accepted as a defense against criminal prosecution, the reasons why it exonerates are subject to dispute and disagreement. Duress is not easily recognizable as either an excusing or justifying condition. Additionally, duress is generally not permitted as a defense against criminal homicide, though some American jurisdictions allow the defense in felony-murder cases. In this paper, I present an argument for how and why the presence of duress can defeat a finding of criminal responsibility. (...) This is intended to establish the philosophical foundation for the legal acceptability of the duress defense, even though I conclude that the defense does not qualify as either an excuse or a justification. I also argue that the duress defense should be allowed in cases of homicide. (shrink)

Philosophy of film without theory is a methodology that aims to motivate and legitimise the current and future development of a range of a-, non-, and anti-theoretical ways of working at the intersection of film and philosophy. We contrast philosophy of film without theory with the main traditions of theoretically orientated philosophy of film, as well as philosophically inflected film Theory and film-philosophy. We also draw attention to the range of philosophical practices and pursuits that distinguish philosophy (in general) without (...) theory and contemporary philosophy (in general) with its near ubiquitous theoretical presumption. The paper finishes with a brief introduction to the various contributions to this Special Issue of Aesthetic Investigations on Philosophy of Film Without Theory. (shrink)

This work contains newly translated excerpts from Samuel Pufendor's two major works in political and moral thought, Elements of Universal Jurisprudence and The Law of Nature and Nations. The editor and translator have worked to present a readable and comprehensive introduction to Pufendorf's political philosophy. The new English translation far exceeds what is currently available in terms of sophistication and clarity. A substantive introduction is included to acquaint readers with Pufendorf's ideas.

This paper assesses the extent to which the category of hope assists in preserving and redefining the vestiges of utopian thought in critical social theory. Hope has never had a systematic position among the categories of critical social theory, although it has sometimes acquired considerable prominence. It will be argued that the current philosophical and everyday interest in social hope can be traced to the limited capacity of liberal conceptions of freedom to articulate a vision of social transformation apposite to (...) contemporary suffering and indignity. The background to these experiences is the structural changes associated with the injustices of globalisation, the mobilisation of the capitalist imaginary and the uncertainties of the risk society. The category of hope could assist in sustaining the utopianism of critical theory through conjoining normative principles with a temporal orientation. Yet, the paradoxes of the current phase of capitalist modernisation have further denuded notions of progress. Since the theological background to the category of hope constitutes a major limitation, the utopian orientation of critique is clarified in relation to the antinomies of the turn to social hope and the potential of Habermas' discourse theory of democracy, law and morality. Despite Castoriadis' profound critique of the category of hope, its present usage in social analyses will be seen to have affinities with Honneth's conception of the struggle for recognition. The work of Dan Brock and Helga Kuhse is typical of the current stream of thought rejecting the validity of sanctity of life appeals to instill objective inviolable worth in human life regardless of the quality of life of the patient. The context of a person's life is supremely important. In their systems life can have high value, yet the value of life can be outweighed by the force of other disvalues. The notion of quality of life has increasingly come (...) to signify the measurement of the worth of a person's life itself. Having a life equals personal life. Any objectivity to life resides in 'personal', 'biographical', or 'creative' life, not mere biological life. Personal life represents the minimal threshold for any objective worth. In responding to this challenge, John Finnis has argued extensively that life is an intrinsic good – a basic human good. Following from our grasp of human life as a basic incommensurable good, it cannot be practically reasonable both to affirm that (a) 'human life is a basic human good', and (b) that 'human life qua human life can be intentionally acted against to its destruction'. Yet, if the good of human life can be considered self-evident, the self-evidence of the basic human good qua good does not mean that dialectical reasoning cannot be engaged in to indirectly support the practical reasonableness of respecting the good of human life in the deliberative choices that persons make concerning their actions. It is to the use of such dialectical reasoning, supportive of the status of human life as such a basic human good, that the article is primarily concerned to draw out and articulate. (shrink)

This essay presents ecosemiotics as an approach to interpreting Heidegger in environmental philosophy. Comparisons between Heidegger’s philosophy and ecosemiotics have often focused on the 1929–1930 lecture course where Heidegger discusses Jakob von Uexküll’s notion of Umwelt. These and other ecological interpretations reach an impasse with the sharp ontological boundary Heidegger places between Dasein and more-than-human lifeforms. This essay revisits the theme by focusing on a central concept from Heidegger’s later work: enframing [Gestell]. Enframing, it is argued, can be understood as (...) a rupture between human (cultural) and natural signs, which is a consequence of technological modernity. Although this interpretation diverges from Heidegger’s philosophy, such critical readings may be necessary if Heidegger’s work is to speak to today’s technologies and ecological issues. (shrink)

The Scottish moral philosopher Adam Ferguson (1723–1816) is recognized as one of the founding fathers of sociology and social science more generally. This article examines his early ruminations on what has come to be seen as one of the most pressing methodological concerns for social science: the problem of ethnocentrism. The article explores Ferguson’s attempts to deal with this problem and his attempt to plot the relationship between empirical research, theory formation and normative moral judgement. It argues that Ferguson was (...) well aware of the danger of cultural bias and that his understanding of moral science is marked by a concern that empirical and normative judgements are freed from the danger of bias.
